Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Smart41 websites, the Nova desktop application and related services (together, the “Services”) provided by ConAIs (“ConAIs”, “Smart41”, “we”, “us”). By creating an account, completing a purchase or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. The Services

Nova is a compliance-first AI marketing operator that plans, writes and runs outbound across channels such as LinkedIn, email, X, Reddit and voice. You direct the strategy and brand voice; Nova performs the execution. Some features (for example the AI voice agent) are made available only under separate scope and pricing.

2. Accounts

You must provide accurate registration information and keep your password confidential. You are responsible for activity under your account. You must be authorized to use any third-party accounts (LinkedIn, email, etc.) you connect to the Services, and to send outbound communications through them.

3. Acceptable use

You agree not to use the Services to send unlawful, deceptive, harassing or infringing content, to violate the terms of any connected platform, or to send communications in breach of applicable marketing, anti-spam and data-protection law (including the EU AI Act, GDPR, ePrivacy/PECR, TCPA and equivalent rules). Every send is subject to your approval, and you remain responsible for the content you approve.

4. Fees and billing

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Plans renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period and fees already paid are non-refundable except where required by law.

5. Intellectual property

We retain all rights in the Services and our software. You retain ownership of your data, brand assets and the content you approve. You grant us a limited licence to process that content solely to provide the Services.

6. AI-generated content

Nova drafts content using AI models. You are responsible for reviewing and approving output before it is sent. AI disclosure is applied where required (EU AI Act Art. 50), and every decision is logged with a SHA-256 audit trail.

7. Disclaimers and liability

The Services are provided “as is” without warranties of any kind to the maximum extent permitted by law. We are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

8. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms. On termination you may request export or erasure of your data as described in our Privacy Policy.

9. Changes

We may update these Terms from time to time. Material changes will be notified through the Services or by email, and the “Effective” date above will be updated.
